Terms & Conditions

Effective Date: 5 August 2026

These Terms and Conditions apply to all catering orders placed with Latoya Latimer Catering ("we", "our", "us"). By placing an order, you agree to these Terms and Conditions.

1. Orders

Orders can be placed through our website, by email or by phone.

An order is not confirmed until we have accepted your booking and provided written confirmation.

We reserve the right to decline an order where products, staffing or delivery capacity are unavailable.

A minimum order value of $100.00 applies to all catering orders.

2. Pricing

All prices are in Australian Dollars (AUD).

Prices include GST unless otherwise stated.

Prices are subject to change without notice. However, confirmed orders will be charged at the quoted price.

3. Payment

Payment for online orders is required at the time of checkout using the payment methods available on our website.

For approved corporate accounts or orders arranged directly with Latoya Latimer Catering, payment may also be made by direct deposit. Payment details will be provided on your invoice.

Unless otherwise agreed in writing, all orders must be paid in full prior to delivery or collection.

Corporate customers with approved trading terms are required to pay all invoices by the due date stated on the invoice.

Any overdue accounts may incur interest and reasonable debt recovery costs to the extent permitted by Australian law.

4. Delivery

Free delivery is available within the Mackay region for catering orders of $100 or more.

Delivery is also available to locations within a 30 km radius of Mackay. Delivery charges apply outside the Mackay region and will be advised when your order is confirmed.

Delivery times are estimates only. While every effort is made to deliver on time, we are not liable for delays caused by circumstances beyond our reasonable control.

The customer is responsible for ensuring someone is available to receive the order at the nominated delivery time.

Where incorrect delivery details are provided or no one is available to receive the order, additional delivery charges may apply.

5. Collection

Customers collecting orders are responsible for ensuring food is transported safely after collection.

Responsibility for the order transfers to the customer once it has been collected.

6. Cancellations and Changes

Order changes are subject to availability.

Cancellation requests should be made as soon as possible.

The following cancellation fees may apply:

  • More than 7 days before the event: Full refund of any payment received.

  • Between 3 and 7 days before the event: Up to 50% of the order value may be charged.

  • Less than 72 hours before the event: Up to 100% of the order value may be charged, as food preparation, purchasing and staffing may have already commenced.

7. Dietary Requirements and Allergies

We take reasonable care when preparing food for customers with dietary requirements.

However, our kitchen handles ingredients including nuts, dairy, eggs, gluten, seafood and other allergens. We cannot guarantee that any item is completely free from traces of allergens.

Customers are responsible for advising us of any allergies or dietary requirements when placing their order.

8. Food Safety

Food should be consumed as soon as practical after delivery or collection.

We are not responsible for the quality or safety of food that has not been stored, transported or handled in accordance with food safety guidelines after delivery or collection.

9. Returns and Refunds

Due to the perishable nature of our products, refunds will generally only be provided where required under the Australian Consumer Law.

If there is an issue with your order, please contact us as soon as possible so we can investigate and work with you to resolve the matter.

10. Website Use

The content on this website is provided for general information only.

You must not copy, reproduce, distribute or use any content from this website without our prior written permission.

11. Limitation of Liability

To the extent permitted by law, our liability is limited to:

  • Replacing the goods supplied.

  • Supplying equivalent goods.

  • Providing the service again.

  • Refunding the amount paid for the relevant goods or services.

Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

12. Force Majeure

We are not liable for any delay or failure to perform our obligations where the delay or failure results from events beyond our reasonable control.

This includes, but is not limited to:

  • Severe weather

  • Floods, bushfires or other natural disasters

  • Road closures or traffic incidents

  • Power outages or equipment failure

  • Government restrictions or public health orders

  • Industrial action

  • Supplier shortages

  • Any other unforeseen event beyond our reasonable control

Where a Force Majeure event affects an order, we will make every reasonable effort to notify you promptly and, where possible, reschedule the booking or provide an alternative solution. Where rescheduling is not possible, any refund or credit will be determined based on the circumstances and any reasonable costs already incurred.

13. Privacy

Your personal information is collected, stored and managed in accordance with our Privacy Policy.

14. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia.

Any disputes arising from these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of Queensland.
